INTERFERENCE IN THE PROFESSIONAL ACTIVITIES OF JUDGES BY CITIZENS AND PUBLIC ASSOCIATIONS

Abstract

Existing cases of interference in the professional activity of judges, subjects of which have certain power or official powers should be considered as threatening not only the judge, but the judiciary as a whole. Based on the analysis of the situation regarding the prevention of interference in the activities of judges in European countries, it should be noted that the international community is most concerned about those cases when it is not a specific judge or a specific case that is under threat, but the foundations of the separation of powers and the system of checks and balances. Guided by such considerations, we come to the conclusion that a methodological shift is necessary for the study of individual cases of interference in the professional activity of a judge. The content of this shift consists in the assumption of the absence of any other influence on the judiciary by individual citizens and public associations, than that which may be allowed by a specific judge in a specific case.


Based on the results of the survey, we confirmed the expediency of an in-depth study of individual elements of the organizational and legal mechanism for preventing interference in the professional activity of a judge. Currently, the formulation of recommendations for strengthening such aspects of the mechanism as the strategy for the development of legal and organizational support for the prevention of interference in the professional activity of a judge, the improvement of the organizational and legal principles of effective countermeasures against interference in the professional activity of a judge, as well as the development of deontological and communicative aspects of organizational and legal mechanism for preventing interference in the professional activity of a judge.
