Abstract

The development of the legal basis for the development of professional legal awareness of a judge depends on the effectiveness of the comprehensive implementation of measures aimed at the formation, improvement and monitoring of legal awareness based on a dynamic approach. However, in connection with the presence of threats to the independence of judges, the implementation of such an approach requires caution and proper methodological justification.


In such a case, the methodological guideline can be the search for ways to overcome the degradation of the judge's legal awareness.


Empirical studies of the factors of degradation of professional legal awareness of judges have not been conducted at the current stage. The theoretical basis of this study was the works of Aidinlis S., Horák, F., Khorakiwala, R., Klocek, A., Lacko, D., Bevs S., Groshevoyo Y., Kim, K., Mikhailina T., Panchuk I. O. and others


The purpose of the article is to substantiate the structure and importance of factors of degradation of professional legal awareness of a judge.


Ultimately, based on the results of the conducted empirical research, we managed to fully or partially confirm all the proposed hypotheses. Summarizing the research results proves that: a) the dynamics of professional legal awareness of judges is related to democratic processes and the foreign policy course of the state, as well as the quality of organizational and legal support for the functioning of the justice system and the influence of judicial self-government bodies and civil society institutions; b) countering the degradation of the professional legal awareness of judges is not a threat to the independence of the judiciary if it is carried out in a legal manner to achieve the goal of strengthening trust in the judiciary in the light of European integration processes; c) legal psychology and legal behavior are the most important components of legal awareness, according to which the degradation of professional legal awareness of judges can mainly occur; at the same time, certain risks are observed for each of the other components; d) the main stages at which the threat of degradation of the professional legal awareness of judges is the highest are the beginning of a legal career and the professional activity of a judge.
